Welcome to Borehole. These Terms of Service ("Terms") govern your access to and use of the Borehole website, services, and applications (collectively, the "Service"), operated by Borehole ("we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
Borehole provides a peer-to-peer (P2P) file transfer utility that allows users to send and receive data directly between devices.
Because Borehole facilitates the transfer of massive files, it is imperative that the Service is not abused. You agree not to use the Service to transfer, share, or distribute:
We do not monitor the contents of your transfers. Because all transfers—including those utilizing Backup Cloud Routing—are end-to-end encrypted, we do not have access to the files you send. However, if we receive credible reports of abuse, we reserve the right to immediately terminate your access to the Service.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or entirely secure.
In no event shall Borehole, its directors, employees, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Your sole and exclusive remedy for dissatisfaction with the Service is to stop using the Service and cancel your subscription. In no event shall our total liability to you for all damages exceed the amount you paid us in the past twelve (12) months.
You agree to indemnify, defend, and hold harmless Borehole from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your use of the Service or your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of Pennsylvania, United States, without regard to its conflict of law principles.
We reserve the right to modify these Terms at any time. We will notify Operators of significant changes via the email associated with their account. Continued use of the Service after changes constitute your acceptance of the new Terms.
